• Participant agreement, release, and acknowledgement of risk

In consideration of the services of Streamline fitness, LLC their agents, owners, officers, volunteers. Participant, employees, and all other persons or entities acting in any capacity on their behalf (thereinafter collectively referred to as 'STREAMLINE FITNESS*), 1 hereby agree to release and discharge STREAMLINE, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. I acknowledge that this activity entails known and unanticipated risks which could result in physical or emotional injury paralysis, death, or damage to third parties or myself. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity I acknowledge that these risks involved in this activity cannot be controlled nor fully disclosed, as there are many unforeseen risks. I am fully aware that 1 am entering into an activity that could result in but not limited to my death, paralysis, musculoskeletal injuries, head injuries, physical injuries and emotional injuries. These risks that 1 am accepting could be result of my own actions, my own negligence and the actions and the actions and the negligence of other righters, competiton, visitor, competiton, visitors, participams, or other persons who may be present, Furth more, STREAMLINE employees have difficult jobs to perform They seck safety, but they are not infallible. They might be ignorant of a participant's fitness or abilties. They give inadequate warnings or instructions and the equipment being used might malfunction.

2. I expressly agree and promise to accept and assume all of the risks exiting in this activity. My participation in this activity is purely voluntary, and elects to participate in spite of the risks.

1. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless STREMALINE from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of streamline's equipment of facilities, including any suck claims, which allege to negligent acts or omissions of STREAMLINE.
2. Should STREAMLINE or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce the agreement, I agree to indemnify and hold them harmless for all such fees and costs.

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else to bear the costs of such injury or damage myself. I further certify that i have no medical or physical conditions, which could interfere with in this activity, or eke 1 am willing to assume and bear the costs of -all isks that may be created directly or indirectly, by any such condition.

In the event that I file a lawsuit against streamline, I agree to so solely in the state of TEXAS, and I further agree that the substantive law if that state shall apply in that action without regard to that conflict of law rules of that state.

By signing this document I acknowledge that of anyone is hurt or property is damaged during my participation in this activity, I may be found by court of law to have waived my right to maintain a lawsuit against STREAMLINE on the document. I have read and understood it, and I agree to be bound by its terms.
